General terms and conditions of business


1. **Scope of Application**

These terms and conditions apply to all orders placed through our online shop D3monic-Store. They govern the contractual relationship between you (the customer) and us as the operator of the shop.

2. **Contract Conclusion**

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the order button, you submit a binding order for the goods contained in your shopping cart. After receiving your order, you will receive an order confirmation by email. The contract is concluded as soon as we accept your order by sending an order confirmation via email.

3. **Products and Production**

Our products are produced using Printify's print-on-demand process only after an order is received. This may result in slight variations in color and print placement. Please refer to the product description for size and material information.

4. **Prices and Payment Terms**

All prices are in Swiss francs (CHF) and include VAT where applicable. The prices valid on the day of order placement apply. Payment is processed via the payment methods offered in the Shopify checkout (e.g., credit card, PayPal). By selecting a payment method, you authorize Shopify to share your payment information with the relevant payment provider.

5. **Manufacturing and delivery times**

Since your products are only manufactured after your order is received, the average production time is 2–7 business days. Your order will then be shipped via Printify. The following shipping methods are available:

  • **Economy**: inexpensive shipping method; delivery within the USA in 4–8 business days
  • **Standard**: 2–5 working days in the country of origin, 10–30 working days internationally
  • **Priority**: 2–3 business days (depending on availability) domestic, 3–5 business days international
  • **Express**: 2–3 working days including production (for selected products such as certain T-shirts)

The final delivery time is calculated from the production time plus the shipping time and depends on the destination country. For deliveries to countries outside the European Union, customs duties, taxes, and other charges may apply, which are your responsibility.

6. **Delivery and Transfer of Risk**

Delivery will be made to the address you provided. Please ensure that the delivery address is correct. The risk of accidental loss or damage to the goods passes to you upon handover to the shipping company. If a return is necessary due to an incorrect address, you will be responsible for the shipping costs of the reshipment.

7. **Right of withdrawal and returns**

Custom-made products are not eligible for return. Since all items are printed only after an order is placed, orders cannot be canceled or changed once production has begun. Returns are not accepted for incorrectly ordered sizes or colors. Detailed information can be found in our cancellation policy.

In the event of a manufacturing defect or damage, we offer a free replacement or refund if you notify us within 30 days of delivery, stating your order number and including a photo of the defect.

8. **Warranty and Liability**

The statutory warranty rights apply, with the proviso that only manufacturing or printing errors are recognized for print-on-demand items. In case of transport damage, you must contact us within 30 days. We are liable without limitation for damages caused intentionally or by gross negligence, as well as for injuries to life, body, or health. In the case of damages caused by slight negligence, we are only liable for breaches of essential contractual obligations. Liability under the Product Liability Act remains unaffected.

9. **Retention of Title**

The goods remain our property until full payment is received.

10. **Copyright and Usage Rights**

All designs, texts, and graphics on this website are protected by copyright. Use without our express written consent is prohibited. You do not acquire any rights of use to the designs displayed in the shop, except for the purpose of private use of the purchased product.

11. **Data Protection**

Information on the collection, processing and use of personal data can be found in our privacy policy.

12. **Applicable Law and Jurisdiction**

Swiss substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for disputes arising from this contract is the operator's registered office, unless you have a general place of jurisdiction in Switzerland.

13. **Final Provisions**

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.
